1. Acceptance of Subscription Terms and Conditions. These terms and conditions (the “Agreement”) govern your enrollment and participation in the Bean.Co Cafe Unlimited Beverage Subscription Program (the “Subscription” or “Membership”), available through www.beanco-usa.com. The Subscription is provided by Bean.Co Cafe, LLC (“Bean.Co Cafe,” “we,” or “us”). By enrolling and using the Subscription, you accept and agree to be bound by this Agreement, including our Privacy Policy and Terms of Use, which are incorporated herein by reference. If you do not accept these terms, do not subscribe. Continued participation constitutes your acceptance of future updates, which we may make at our discretion. In the event of a conflict between these terms and any other Subscription-related terms, this Agreement shall prevail.

IMPORTANT: THIS AGREEMENT INCLUDES A MANDATORY ARBITRATION CLAUSE AND A CLASS ACTION WAIVER, WHICH MEANS DISPUTES WILL BE RESOLVED THROUGH INDIVIDUAL ARBITRATION RATHER THAN IN COURT. SEE SECTION 9 BELOW.

Subscribers must be at least 18 years old.

2. Revisions to this Agreement. Bean Co Cafe reserves the right to update this Agreement from time to time. Updates become effective on the date they are posted on www.beancousa.com. Continued use of the Subscription after changes are posted indicates acceptance of the revised terms. We reserve the right to change or discontinue features or benefits at any time, at our discretion.

3. Electronic Consent. By using the Subscription, you consent to receive all agreements, notices, and communications electronically, including by email, text message, mobile app notifications, or posted notices. These satisfy any legal requirement for written communication.

4. Subscription Eligibility. To enroll, you must provide accurate and up-to-date information. Misrepresentation or misuse may result in suspension or termination of your account. Each Subscription is personal and non-transferable. Eligible beverages, benefits, and participation may vary by location.

5. Subscription Features.

Coffee Plan Monthly Fee: $29/month (plus tax)

Included Beverages: Brewed coffee (hot/iced), hot tea, redeemable every two hours during cafe hours, plus 10% on select items such as Crepes, Sandwiches, Baked Pastry, Smoothies, and Bowls

Espresso Plan Monthly: $49/month (plus tax)

Included Beverages: Brewed coffee (hot/iced), hot tea, and select espresso drinks, redeemable every six hours during cafe hours during a single visit, plus 10% on select items such as Crepes, Sandwiches, Baked Pastry, Smoothies, and Bowls. Some customizations, such as alternative milks, are included; premium customizations may incur additional charges. Excludes bottled drinks and other specialty items unless otherwise specified.

Benefit Redemption: Valid only in participating Bean Co Cafe locations. Benefits expire at the end of each operating day and do not carry over. The Subscription may not be used for bulk orders or resale. Delivery or third-party apps may not support Subscription redemptions unless explicitly stated.

6. Billing & Payments. Subscribers authorize Bean Co Cafe to charge the selected payment method on a recurring basis until the subscription is canceled. Payment failures may result in suspension. We reserve the right to correct billing errors and update stored payment methods using third-party services.

7. Subscription Renewal and Cancellation.

7.1 Recurring Billing: Subscriptions renew automatically each billing cycle (monthly or annually).

7.2 Cancellation: You may cancel your subscription anytime via your online account or by contacting Bean Co Cafe Customer Service. Cancellations are effective at the end of the current billing cycle. No refunds will be provided for partial periods.

7.3 Price Changes: Subscribers will be notified at least 10 days in advance of any fee increase.

8. Subscriber Responsibilities. You must notify Bean Co Cafe of any billing or account security issues, such as lost payment cards or unauthorized access. Failure to update account info may result in continued charges.

9. Dispute Resolution – Arbitration & Class Action Waiver.

Disputes must first be resolved informally. If unresolved, all disputes shall be submitted to binding individual arbitration under the rules of the American Arbitration Association. You waive the right to join claims or participate in class actions. The arbitrator may not consolidate claims or award relief to anyone other than the individual parties. Arbitration shall occur telephonically or in your county of residence unless otherwise agreed.

This section survives termination of your Subscription. If any part of this arbitration agreement is deemed unenforceable, the remainder remains in effect.

10. Additional Terms. Bean Co Cafe may offer promotional or location-based benefits to certain subscribers at its discretion. Subscription terms and benefits are subject to change.
